CORE TERMS OF USE PROVISIONS

Misrepresentation and Catfishing Policy

At DateNight, we are committed to creating a safe, authentic, and trustworthy community for all our users. To uphold these values, we enforce strict rules regarding misrepresentation, including but not limited to catfishing, impostor behavior, or the use of deceptive profile imagery.

Prohibited Behaviors

  1. Catfishing: Catfishing refers to creating a false identity on the platform to deceive or manipulate others. This includes, but is not limited to:
    • Using fake names, ages, genders, or other personal details.
    • Pretending to be someone else, whether a real person or a fabricated identity.
    • Misleading others by using another person’s photos or unauthorized likeness.
  2. Impostoring Accounts: Impersonating another person or entity, including public figures, celebrities, or any other identifiable individual, is strictly prohibited. This includes:
    • Using someone else’s photos, name, or identifying information to create a false identity.
    • Claiming to represent an organization or individual without authorization.
  3. Use of AI-Generated or Fake Profile Imagery: Profile pictures must be an accurate representation of your actual appearance, as verified during the KYC (Know Your Customer) process through your face scan or submitted documents. The use of:
    • AI-adapted profile pictures or avatars that significantly alter your appearance.
    • Fake, heavily filtered, or doctored photos that mislead others about your identity.

Consequences of Breach

Any user found to be engaging in catfishing, impostoring, or using misleading profile images will face immediate account termination with no refund of subscription or service fees. This action is non-negotiable and will be enforced without the possibility of appeal.

Verification Requirement

All users are required to upload a profile picture that is a true and accurate representation of their appearance, matching the photo submitted during the KYC process. Users who fail to comply or deliberately upload deceptive imagery will be banned from the platform.

By using DateNight, you agree to these terms and acknowledge that failure to comply may result in the loss of access to your account and all associated services.

Date Night’s Services are provided “as is”—we do not make any guarantees about performance, uptime, or content.

DISCLAIMER OF WARRANTIES

  1. No Express or Implied Warranties: DATE NIGHT PROVIDES SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND—WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE—including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, non-infringement, or satisfactory quality.
  2. No Guarantee of Uninterrupted Service: We do not guarantee uninterrupted, secure, or error-free operation.
  3. No Endorsement of Content: We do not endorse or guarantee the accuracy or completeness of user-generated content.
  4. Assumption of Risk: Any material obtained through our Services is accessed at your own risk. We are not responsible for damage to devices or data resulting from viruses, hacking, or other malicious activity.

Additionally, Date Night does not promise:

  • Any minimum number of active users
  • Certain user behaviors or compatibility outcomes
  • Accountability for user content or identity

Use your own judgment and stay vigilant for potential misuse, scams, or misleading information.

Short Summary of Our Terms of Use

  • California Subscribers: You may cancel your subscription, without penalty or obligation, any time before midnight of the third business day following the date you subscribed.
  • If you subscribed using an External Service (Apple ID, Google Play), you must cancel via that External Service (details in Section 8a). Apple ID subscriptions/refunds are handled by Apple.
  • All other users may request a refund by contacting Date Night Customer Service or by mailing a signed, dated notice that states you (the buyer) are canceling.

We provide brief summaries at the start of each section to help you understand, but please read each section in full.

INTRODUCTION

By accessing or using Date Night’s Services, you agree to be bound by this Terms of Use Agreement (the “Terms” or “Agreement”), including our Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips. Please read this Agreement carefully before creating an account.

IMPORTANT:
Carefully review the Dispute Resolution Provisions. This includes a mandatory pre-arbitration informal dispute resolution (except for individual sexual assault/harassment claims), an arbitration agreement, small claims court election, a class action waiver, additional mass arbitration protocols, and a jury trial waiver.

We may update these Terms from time to time—check here regularly for updates. Your continued use after we post changes indicates acceptance.

If you do not wish to be bound by these Terms, you must not access or use our Services.

These Terms apply to anyone who accesses our Website, App, or other Services, regardless of registration or subscription status.

Your access/use is also subject to any Additional Terms Upon Purchase you accept when buying features, products, or services.

Subject to applicable law, we reserve the right to modify or change the Terms at any time. We’ll post material changes on this page (with an updated effective date). We might also notify you via email or other methods. You are responsible for checking for changes. Continuing to use the Services means you consent to those changes.

ACCOUNT ELIGIBILITY; YOUR RESPONSIBILITIES

Before creating an account, make sure you meet these criteria. By using our Services, you represent and warrant that:

  1. Age & Entity: You are at least 18 years old and an individual (not a corporation or other entity).
  2. Legal Capacity: You can form a binding contract with Date Night.
  3. No Sanctions: You are not located in, or associated with, countries subject to U.S. embargo or on prohibited party lists.
  4. Not Prohibited by Law: You are not barred by law from using our Services.
  5. No Serious Criminal History: You have not been convicted of, or pled no contest to, a felony or violent/sex crime (unless clemency was granted and Date Night deems you not a risk).
  6. Sex Offender Registry: You are not required to register as a sex offender.
  7. Single Account: You do not have more than one Date Night account.
  8. No Prior Removal: You haven’t been removed from Date Night or affiliates’ services before, unless we gave you express written permission.

If you no longer meet these requirements, you must immediately delete your account and cease use. We reserve the right to revoke your access without notice.

You Agree to:

  • Comply with these Terms; check this page periodically for updates
  • Abide by all laws, including privacy and IP laws
  • Use the Latest Version of the Website or App
  • Review our Safety Tips
  • Review and follow the Community Guidelines (as updated)
  • Protect the security of your login credentials

You Will Not:

  • Misrepresent your identity, age, or affiliations
  • Damage or hamper the Services for other users
  • Use the Services in a way that interferes with servers or networks
  • Use the Services for illegal or harmful purposes (money laundering, etc.)
  • Harass, bully, stalk, assault, or defame others
  • Post Prohibited Content (see below)
  • Solicit passwords or personal info for unlawful or commercial use
  • Solicit money or valuables from other users (gift/loan/compensation)
  • Use another user’s account
  • Engage in fraud, pyramid schemes, or unethical practices
  • Use the Services for political campaign financing or to influence elections (beyond personal opinions)
  • Violate the license terms
  • Disclose private/proprietary info you have no right to share
  • Copy, modify, or distribute Member or Our Content without consent
  • Imply Date Night endorses your statements
  • Use robots, crawlers, or indexing to mine data
  • Upload viruses or malicious code
  • Frame or mirror any part of the Services without written permission
  • Use meta tags referencing Date Night or its brand without consent
  • Reverse engineer or disassemble the Services
  • Create or use third-party apps that interact with our Services without permission
  • Probe or scan the vulnerability of our system/network
  • Encourage or promote activities that violate these Terms
  • Create a new account after suspension or termination without permission
  • Submit false or misleading reports about another user’s behavior

Prohibited Content includes material that:

  • Harasses or abuses another person, or causes psychological distress
  • Is obscene, pornographic, or violent (includes nudity in violation of local guidelines)
  • Is abusive, threatening, discriminatory, or encourages racism/sexism/hate
  • Encourages or facilitates illegal activities (terrorism, incitement, etc.)
  • Encourages or facilitates any activity leading to harm (self-harm, dangerous challenges, violent extremism)
  • Is defamatory, libelous, or untrue
  • Is commercial in nature without authorization (sales, competitions, promotions, references to sex work)
  • Involves spam or destructive code (spyware, viruses, worms)
  • Infringes on third-party rights (IP or privacy)
  • Depicts another person without consent (or minors without parental consent)
  • Depicts minors in sexual or exploitative situations
  • Is inconsistent with the intended use of the Services
  • May harm the reputation of Date Night or affiliates

Posting such Prohibited Content can lead to immediate suspension or termination of your account.

CONTENT

While using our Services, you may encounter:

  1. Your Content: Anything you upload or provide (e.g., text, images, video)
  2. Member Content: Content uploaded by other users
  3. Our Content: All content provided by Date Night

a. Your Content

You are fully responsible for whatever you share. Do not post content you wouldn’t want others to see or that could violate these Terms or expose you or us to liability. By posting, you agree to indemnify Date Night from claims related to Your Content.

You must ensure the information you provide is accurate and up to date. You may not post personal or banking details (yours or someone else’s). Revealing personal data is at your own risk; exercise caution.

Visibility: Your profile may be visible globally, so confirm you’re comfortable with that. Others may share Your Content with third parties. By uploading, you confirm you have the necessary rights/licensing.

We may offer features that let you enhance or generate content (e.g., AI-based), but it remains Your Content, and you bear responsibility for it. We reserve the right to monitor, remove, edit, or block access to Your Content at our discretion. We do not guarantee it will be displayed.

b. Member Content

Member Content belongs to the user who posted it. You don’t have rights to another user’s content beyond viewing it within our Services. Do not copy, spam, harass, or threaten others using their content. We may terminate accounts for misuse.

c. Our Content

All text, graphics, trademarks, logos, and other IP on our Services belong to Date Night or its licensors. You get a limited license to view and use it for personal, lawful use only.

INAPPROPRIATE CONTENT AND MISCONDUCT; REPORTING

We do not tolerate inappropriate content or behavior. If you see something violating these Terms, please report it via the Report User link or Customer Support.

We may share data with affiliates for safety/security. If you violate these Terms, we may ban you from Date Night and its affiliates. We may also limit your ability to create new accounts.

Member Content may also be subject to the DMCA takedown process.

PRIVACY

Privacy matters. Read our Privacy Policy to see how Date Night and affiliates collect, use, and share your personal data. By using the Services, you acknowledge and agree to these practices.

RIGHTS YOU ARE GRANTED BY DATE NIGHT

So long as you comply with these Terms, Date Night grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, non-sublicensable license to access and use our Services as intended and permitted by applicable laws. This authorization ends if you violate these Terms.

RIGHTS YOU GRANT DATE NIGHT

You own the content you provide, but you grant us the necessary rights to use it as described. Specifically, by creating an account, you grant Date Night a worldwide, perpetual, transferable, sub-licensable, royalty-free license to host, store, reproduce, adapt, publish, modify, reformat, distribute, publicly display, and otherwise make Your Content available to the public in any format.

  • This includes authority for Date Night to act on your behalf to prevent infringement of Your Content on third-party sites.
  • You allow us (and affiliates/partners) to place advertising on the Services.
  • By providing feedback, you agree we can use it without compensation to you.
  • You authorize us to access, preserve, and disclose your account information if law requires or if we believe it’s reasonably necessary for legal or safety reasons (fraud, suspected wrongdoing, etc.).

PURCHASES AND AUTOMATICALLY RENEWING SUBSCRIPTIONS

You may purchase products/services from Date Night. If you buy a subscription, it renews automatically (and you’ll be charged) until canceled.

We may offer items via External Services (Apple, Google) or Internal Purchases (credit card on our Website/App).

Automatic Renewals

If you buy a subscription, it continues until canceled under the terms disclosed at purchase. If canceled, you’ll retain subscription benefits until the current term ends but will not be billed for the next cycle.

Canceling a subscription does not remove your profile or account. To fully terminate, see Account Termination.

We may run promotional rates, which can vary by region or subscription length. We also reserve the right to limit or discontinue products or to refuse transactions at our discretion.

EXTERNAL SERVICE PURCHASES AND SUBSCRIPTIONS

If you buy through Apple ID, Google Play, or similar, your subscription is billed through that External Service. You must manage cancellations within that external platform.

  • Auto-Renew: The External Service will periodically charge you unless you cancel.
  • To cancel, sign in to your Apple/Google (or other) account and follow the instructions.
  • If you charge back or reverse payment, we may terminate your Date Night account. If that chargeback is reversed later, contact Customer Care to resolve it.

Refunds for External Service purchases may be handled by the External Service (e.g., Apple).

INTERNAL PURCHASES AND SUBSCRIPTIONS

If you purchase directly on our Website/App:

  1. You agree to pay the prices shown, plus any taxes.
  2. You authorize Date Night to charge the Payment Method you provided.
  3. We may correct billing errors even after we’ve received payment.
  4. If you initiate a chargeback or payment reversal, we may terminate your account.
  5. If your subscription automatically renews, your Payment Method is charged until you cancel under the instructions in your Account settings.
  6. You can update your Payment Method via Settings. If payment fails, you remain responsible for uncollected amounts.
  7. Certain users may be entitled to refunds.

VIRTUAL ITEMS

Sometimes we offer limited-use features, e.g., credits for Boosts or Gifts (“Virtual Items”). You can purchase them from us or authorized partners. No ownership in Virtual Items is transferred to you; it’s a limited license. They don’t hold real-world monetary value, are non-refundable, and may be modified or discontinued at any time.

All Virtual Item purchases and redemptions are final and non-refundable. You won’t get cash or compensation for unused Virtual Items if your account closes, voluntarily or otherwise.

REFUNDS

Generally, all purchases are final and non-refundable, with no partial credits. Exceptions apply if local laws mandate refunds:

  • EU, EEA, UK, Switzerland: Full refund within 14 days of subscription start.
  • Germany: May terminate subscription after renewal with one month’s notice.
  • Republic of Korea: Full refund on subscription/unused Virtual Items within 7 days of purchase.
  • Certain U.S. States (Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, Wisconsin) & Israel: Cancel anytime before midnight of the third business day after subscription. If you die before subscription ends, your estate may get a refund for unused portion. If disabled, you might also get a partial refund.

Apple ID subscriptions/refunds must be handled by Apple. For other purchases, contact Date Night Customer Service with your order number or mail a signed, dated notice that you’re canceling this Agreement

ACCOUNT TERMINATION

If you decide to stop using Date Night, or if we terminate your account, here is what happens:

  • You can delete your account any time in your Settings.
  • You still need to cancel or manage any External Service subscriptions to avoid further charges.
  • We reserve the right to suspend or terminate your account without refund if we believe you violated these Terms or otherwise acted inappropriately or unlawfully.
  • Upon termination (by you or by us), these Terms continue to apply regarding any obligations that survive (e.g., disclaimers, liability limitations).
  • Your personal data will be handled per our Privacy Policy.

NO CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS

Date Night does not conduct criminal background checks on users. We use KYC verification to reduce scams, but we do not represent or warrant user conduct or authenticity.

Use caution when interacting with others. Follow our Safety Tips. We can’t guarantee user identity, intentions, or safety. Always use your best judgment, especially when meeting or communicating off-platform.

DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

We take copyright infringement seriously. If you believe that Member Content or Our Content on Date Night infringes your intellectual property, please file a DMCA Takedown Notice with the following:

  1. Signature: A physical/electronic signature of an authorized person.
  2. Identification of Work: The copyrighted work(s) allegedly infringed.
  3. Identification of Infringing Material: Enough info to locate it on our Services.
  4. Your Contact Info: Address, phone, email.
  5. Statement of Good Faith: That the disputed use is unauthorized under law.
  6. Accuracy and Authority: Under penalty of perjury, you are authorized to act on behalf of the owner.

ADS AND THIRD-PARTY CONTENT

Our Services may feature advertisements, promotions, or links to external sites:

  • Advertisements: Some users may see ads or have the option to watch them in exchange for Virtual Items. We do not guarantee ad availability or that you’ll be eligible for any rewards.
  • Third-Party Links: We may provide external references or non-commercial links. Date Night is not responsible for availability or content of third-party resources.
  • No Endorsement: Date Night does not endorse or guarantee third-party products or services. If you choose to interact with them, their terms govern the relationship.

 LIMITATION OF LIABILITY

To the fullest extent allowed by law, Date Night’s liability is limited.

NO CONSEQUENTIAL OR INDIRECT DAMAGES
 We, our affiliates, employees, licensors, or service providers shall not be liable for indirect, exemplary, punitive, or consequential damages—such as loss of profits, data, or goodwill—arising from:

  1. Your use or inability to use the Services;
  2. Any conduct/content of other users or third parties;
  3. Unauthorized access or changes to your content.

If, despite these provisions, Date Night is found liable, our aggregate liability is capped at the greater of:
(A) $100 USD or (B) the total amount you paid to Date Night over the 24 months preceding your claim.

Some jurisdictions disallow limitations of certain damages, so portions of this section may not apply to you.

DISPUTE RESOLUTION SECTION

This section outlines the process if you have a legal dispute with Date Night, except where prohibited by law.

Note: Certain subsections may not apply to users in the EU, EEA, UK, or Switzerland if local law prohibits them.

INFORMAL DISPUTE RESOLUTION PROCESS

If you’re dissatisfied, please contact Date Night Customer Service first. We value good-faith efforts to resolve concerns before escalating.

  • Definition of Dispute: Any claim or controversy arising under these Terms or your relationship with Date Night—even if it arose before you accepted these Terms.
  • Notice: Before filing arbitration or small claims, send a Notice to: Contact@datenight.com
  • Include your full name, account info (screenshots if needed), contact details, and a description of your dispute/relief sought, with a calculation of damages if any. You must personally sign the Notice.

We’ll do the same if we have a dispute with you. Parties then negotiate in good faith for 60 days. If unresolved, either party may proceed with arbitration or small claims (unless it concerns sexual assault or harassment).

This process is a condition precedent to arbitration or small claims court (except for sexual assault/harassment claims).

INDIVIDUAL RELIEF: CLASS ACTION & JURY TRIAL WAIVER

TO THE FULLEST EXTENT allowed by law, both you and Date Night waive:

  • Right to a jury trial
  • Right to class or collective actions

All disputes must be arbitrated (or, where applicable, in small claims court) individually. The arbitrator cannot award relief on behalf of non-parties. If this class waiver is deemed unenforceable for a specific claim (e.g., public injunctive relief), that claim proceeds in court while the remaining claims remain in arbitration.

DISPUTE RESOLUTION THROUGH ARBITRATION OR SMALL CLAIMS COURT

Any dispute not resolved informally shall be exclusively settled by binding individual arbitration, except:

  • Small Claims: Either party can elect small claims court for individual claims.
  • Sexual Assault/Harassment: Individual claims may be brought
  • If small claims is requested post-filing but pre-arbitrator assignment, the arbitration is administratively closed.

If the arbitration agreement is deemed unenforceable, litigation can only occur in the United Kingdom (except where local law mandates otherwise).

FUTURE CHANGES & RETROACTIVE APPLICATION

These Dispute Resolution terms apply to all disputes (past, present, future). You may opt out of retroactive application within 30 days of consenting by writing to Date Night Corp Ltd

GOVERNING LAW

To the fullest extent permissible:

  • The Laws of the United Kingom apply, without regard to conflict-of-law rules.
  • The same laws govern the arbitration process.
  • If you reside in the EU/EEA, mandatory consumer protection laws in your country may override the choice of UK Law.

INDEMNITY BY YOU

By using our Services, you agree to indemnify, defend, and hold harmless Date Night (including affiliates and employees) from any claims, damages, or losses arising out of:

  • Your use of the Services
  • Your Content posted or shared
  • Interactions or disputes with other users
  • Your breach of these Terms

Some jurisdictions may limit indemnity clauses; such limits will apply accordingly.

ACCEPTANCE OF TERMS

By using Date Night—via mobile, app, or web—you confirm:

  1. You’ve read, understand, and accept these Terms
  2. You also accept our Privacy Policy, Cookie Policy and supplementary policies. If you do not accept these Terms, you must not use our Services.

ENTIRE AGREEMENT

These Terms (plus the Privacy Policy, Cookie Policy and supplementary policies) form the entire agreement between you and Date Night regarding the Services, superseding all prior written/oral agreements.

  • If any portion of these Terms is deemed invalid, the rest remains in effect.
  • The failure of Date Night to enforce a right is not a waiver.
  • Your account is non-transferable, and rights to it end at death unless otherwise required by law.
  • No partnership, agency, or joint venture is formed by these Terms.

SPECIAL TERMS FOR RESIDENTS OF CERTAIN LOCATIONS

Israel, Denmark, Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, Wisconsin: Certain laws apply, such as:

  • Cancellation within 3 business days of subscription
  • Refunds for unused portions if death or disability occurs
  • New York:
    • No guaranteed number of “referrals”
